Definitions
A. Agreement means these Terms and Conditions
B. Attendee/s means any individual who attends the Centre and utilises our coworking space or care services.
C. Care Service/s and Care Sessions means child minding services provided by us in accordance with this Agreement for the care of a child/ren at our Centre where the parent/guardian of a child/ren is a member and remains onsite at the centre and is contactable at all times while the child/ren is being cared for.
D. Crèche means the dedicated child-minding area of the Centre.
E. Centre means the building and facilities where CoWork Crèche operates.
F. Member means a person granted Membership by us.
G. Membership means the membership level selected by you.
1. General
1.1. CoWork Crèche is a service designed to make your work as productive and convenient as possible for both you and your child/ren.
1.2. We are more than happy to assist with any queries and suggestions you may have. However, there are certain guidelines that should be brought to your attention.
1.3. We request that you take the time to read these and follow them to ensure we are able to provide you and your child/ren with the best service possible. If you have any further queries or suggestions, please do not hesitate to contact us.
2. Signing in and out of the Centre
2.1. Parents/Guardians must sign into the Centre each time they use our care service and show a valid form of ID. On arrival you must sign both yourself and each child in on the registration schedule. You must also sign out yourself and each child before leaving.
2.2. Every parent/guardian must remain at the centre and be contactable at all times. Parents/guardians are responsible for the care of their child/ren, as such, if called to the crèche must return immediately (failure to do so may result in suspension of service.
2.3. Please be advised that no parent is to leave the centre at any time whilst their child/ren are in our care.
2.4. In the event that you fail to collect your child/ren from our care at the conclusion of your booking time, we will make every effort to contact you and keep your child/ren entertained and safe until the situation is resolved.
2.5. If we are unable to contact you with a reasonable period of time, we will attempt to contact the listed emergency contact. If they are unreachable, we will be left with no option but to contact the police due to our duty of care to your child. Please note an after-hours hourly rate of $80+ GST will be charged during wait time.
2.6. If your child/ren are being collected by somebody other than the parent/guardian signed into our Centre, staff must be informed and you will be required to complete an authorisation form to give permission to that person to pick up your child/ren.
3. Age Groups
3.1. We welcome all babies and children from 8 weeks up to the age of 4 years.
3.2. CoWork Crèche has been divided into two areas, which are activity specific:
3.2.1. Newborns and babies (not walking yet); and
3.2.2. Toddlers/Pre-school aged.
4. Bookings
4.1. We endeavour to cater for all our attendees however there is no guarantee that your preferred time and day will be available.
4.2. Bookings can be made by emailing melody@coworkcreche.com.au or by completing our online website booking form and must be made no later than 24 hours prior to the start time of the session.
4.3. In fairness to our fellow attendees, if you make a booking and then you are unable to attend, it is essential that you call us or email melody@coworkcreche.com.au. This booking system and relevant staffing ratios are in place to ensure that we do not jeopardise your child/ren’s safety.
5. Allergies and Medication
5.1. When booking please ensure you notify us of anything we need to be aware of or any allergies your child may have.
5.2. In the event your child has any allergies, you must complete our Anaphylaxis Information Form prior to attending our Centre so we can ensure all staff are aware and keep your child’s Action Plan on display in our crèche.
5.3. No child who has been prescribed with an EpiPen is permitted to stay at the Centre without their EpiPen. You must bring any emergency medication that may be required for your child which is to be provided to the Centre upon signing your child into our service.
5.4. No medication will be administered at our Centre. If your child requires medication for an ongoing condition i.e. asthma, please ensure that you manage this personally.
5.5. We have a no nuts, egg, peanut butter or peanut based or traceable products, lollies, chewing gum or popcorn policy at our Centre.
5.6. To attend the Centre, children must be fully immunised, or on an approved vaccination catch-up program, or have a medical reason not to be vaccinated.
6. Illness
6.1. To avoid the spread of viruses and illness to our staff and other children, we do not accept sick or unwell children into the crèche. If our staff feel your child is too unwell to be in the creche you will be notified, and you must collect your child from the creche immediately.
6.2. If your child displays any of the following symptoms, they are considered sick: has a fever, mucus from the nose, eyes or mouth, cough, flu, vomiting, diarrhoea or any virus that can be spread or has a visible rash.
6.3. Parents/guardians understand that they are at all times responsible for their child/ren they attend the crèche and authorise the staff to seek necessary emergency medical treatment, or ambulance service in the event of illness or accident occurring to their child and agree to pay any medical and transport costs arising from such an action.
7. Check in Policy
7.1. The maximum time that your child/ren may be left in our care is 3 hours. After a period of 3 hours has elapsed, the sessions ends and you must take your child/ren. You can then commence a new session immediately at the conclusion of the first session.
7.2. This means, we require you to “check in” on your child by visiting your child in our crèche after a period of 3 hours has elapsed whereafter a new session block can commence.
7.3. In the event you have booked a full day (8-hour booking), then you will be required to “check in” on your child on two 3 hourly occasions each day.
8. Staff and Care Services
8.1. The CoWork Crèche Team are either qualified and /or experienced in childcare (a minimum of 12 months experience).
8.2. Parents/guardians can be as involved in the care of their child during the care sessions as they require and we assume that you will feed, change, toilet and put to sleep your child during all care sessions unless otherwise communicated to staff at the commencement of the session.
8.3. In the event you inform staff that you require CoWork Crèche to feed, change, toilet and put to sleep your child, then we require that parent/guardian to provide staff with all items required by your child.
8.4. Please be aware that you may be required to return to the crèche if your child becomes distressed and is unable to be settled by staff or if your child becomes unwell.
9. What to Bring
9.1. Please ensure you clearly label all items for your child, all nappy supplies, clothes, sleep items and bottles. We supply baby wipes, but please bring nappies and creams (or any other nappy change items you would like to use). You will need to bring in a bag for your child:
9.1.1. All food and snacks, please separate these into containers so we know when to feed each item.
9.1.2. Water bottle, milk bottles, formula or expressed milk
9.1.3. Cot sheet and sleep sack.
9.1.4. Spare change of clothes.
9.1.5. Dummies and soothers/blanket.
9.2. In the event you have a membership at our Centre, you are welcome to store any of the above items at the centre for future use.
10. Payment of Fees
10.1. For all casual bookings, we require payment at the time of booking for the selected day/s you have elected to book yourself and your child into our centre.
10.2. For casual bookings, we require 48 hours cancellation notice for a 100% refund or 24 hours’ notice for 50% refund.
11. Memberships
11.1. By accepting Membership with CoWork Crèche, you acknowledge and agree to be bound by these Terms.
11.2. An initial fortnightly payment is required at the time of booking for new members to secure your position. Ongoing membership payments are direct debited fortnightly in advance (from the conclusion of the first fortnightly period of attendance at our Centre) and will be direct debited from your nominated bank account and will continue until your Membership ends in accordance with Clause 11.16.
11.3. All written notification to CoWork Crèche pursuant to your membership must be made by way of email correspondence to melody@coworkcreche.com.au.
11.4. Your membership will commence immediately at the time of your initial fortnightly payment and will continue until such time that you or CoWork Crèche terminate this Agreement in accordance with the terms as set out below.
11.5. If you are a member and you cannot attend your scheduled membership day/s, we offer 1 makeup day per month (the month starts from the date of your first attendance at our Centre). This is subject to availability and is at the discretion of CoWork Crèche. We do not offer make-up days for any casual bookings.
11.6. If an automatic debit arrangement is in place, membership fees will continue to be debited from your nominated account until you or we cancel the membership by notifying your bank or credit provider.
11.7. You will sign all documents necessary to ensure that the fortnightly payment can be made by direct debit.
11.8. You agree that the membership fees are payable, even if you do not use the CoWork Crèche facility, until such time that you or CoWork Crèche terminate this Agreement in accordance with the terms as set out below.
11.9. If you terminate the membership or stop the automatic debit arrangement in a manner not described in these terms, then you may be liable to CoWork Crèche for damages and breach of contract.
11.10. You agree to pay the standard membership fee for your membership type as stated herein or indicated by CoWork Crèche, noting that CoWork Crèche is at liberty to increase the standard weekly fee amount on all membership types, providing a minimum of 60 days’ notice is given.
11.11. It is your responsibility to ensure sufficient funds are in your nominated account when weekly payments are to be drawn and if a debit is unsuccessful, you will be responsible for the payment of an administrative fee per unsuccessful debit.
11.12. You agree to pay 10% interest if your fortnightly payment is received past the due date and/or any fee associated with returned payments or non-payment.
11.13. Should you default, you agree to pay all collection costs including agency fees or administrative charges, court or arbitration costs and reasonable legal fees, which may be paid or incurred by CoWork Crèche Pty Ltd.
11.14. You agree that CoWork Crèche, a third party, their agents and assignees may send communications to you including late payment notifications and other related correspondence.
11.15. The membership fees are non-refundable.
12. Termination of Membership
12.1. Your membership period will terminate 14 days after you provide CoWork Crèche with written notification by email that you intend to terminate your membership (“Termination Notice Period”); or if we terminate your membership.
12.2. CoWork Crèche reserves the right to immediately terminate a Membership in the event of:
12.2.1. A material breach of any of the Agreement clauses and/or your obligations under this Agreement and are unable to cure such breach within 7 days of being formally notified in writing;
12.2.2. A breach of law/regulation/order;
12.2.3. Serious misconduct by a member and/or refusal by a member to comply with reasonable requests by any staff members;
12.2.4. If you become insolvent, are in liquidation or cannot pay your Membership fees when due;
12.2.5. Swearing / offensive language around children or carers;
12.2.6. Aggressive behaviour towards children or cares;
12.2.7. Violence or threats of violence towards children or carers;
12.2.8. Harassment directed towards children or carers;
12.2.9. Discrimination towards children or carers;
12.2.10. Vilification of children or carers;
12.2.11. Bullying directed towards children or carers;
12.2.12. Defamation directed towards children, carers, staff or CoWork Crèche, this includes posts on Social Media.
13. Security
13.1. CoWork Crèche may have security cameras recording 24-hours per day, 7 days per week. This system is used for security purposes but does not guarantee against harm.
13.2. Theft or loss of Property: You agree that CoWork Crèche, its employees, agents or subcontractors are not responsible for any property brought by you to the centre including personal possessions and technology. We do not accept any liability for any loss incurred by a person attending our Centre.
13.3. You shall need to insure for general liability and all sums that you may be legally liable to pay and insure for your own personal property that you bring into the Centre. We shall not be held liable for any loss, theft or damage to your work property, personal items or goods howsoever caused.
14. Access to Centre
14.1. CoWork Crèche has the right to withhold services and prevent entry to our centre without prior notice in the event a Member or Attendee has failed to pay for their Membership Fees in accordance with these terms and/or where the Member or Attendee has breached any part of these Terms and fails to remedy that breach within seven days of notice of breach by CoWork Crèche.
15. Coworking Space
15.1. As a Member or Attendee you have access to the common area work lounge, kitchen area and all common spaces provided by us. This Agreement does not provide any lease hold arrangement for any member workspace or office and is subject, at all times, to these Terms and Conditions.
15.2. We may need to access your workspace and may do so at any time. Other than in an emergency, should we need to access your space, we aim to provide you with as much notice as possible.
15.3. You must:
15.3.1. Comply with all laws and regulations when conducting your business activities and may not use the centre for any unlawful or immoral activity;
15.3.2. You may not obstruct any other person/s business activities or create a nuisance, annoyance or mistreat any persons including our employees in the Centre; and
Such activity shall constitute a material breach of this Agreement and services shall immediately terminate without any pro-rata adjustments.
15.4. You must not:
15.4.1. Alter any part of the appearance of the Centre in any way. You will be liable for any damage caused by you and / or your invited guests;
15.4.2. You are not permitted to sleep or allow any of your guests to sleep overnight in the Centre;
15.4.3. You are not permitted to smoke in the Centre or within 50 metres of any Centre entry or exit;
15.4.4. You may not install any sign in the Centre without our written permission. You may not use our address to advertise your business in anyway.
15.5. You agree that any repairs above reasonable wear and tear for the coworking space utilised by you shall be your responsibility. Any fees associated in bringing the office / workspace / back to its original condition at the end of your membership shall be at your cost.
16. Limitation of liability and Indemnification
16.1. With the exception of gross negligence and or wilful misconduct, in no event shall either party be liable to the other party and agree to indemnify CoWork Creche and its employees or agents against all actions, claims, costs, losses, expenses and damages (including the costs of defending or settling any action or claim) in respect off business interruption, loss of or unauthorized access to data or information, damages for loss of profits, personal injury (including death) or illness to any person or loss of, loss of use of, or damage to any property; resulting from or by reason of anything done or omitted to be done arising out of activities undertaken at CoWork Creche centre.
16.2. Each party shall at its own expense indemnify and hold harmless, and at the other party’s request defend such party its affiliates, subsidiaries, successors and assigned officers, directors, employees, sublicences, and agents from and against any and all claim, losses, liabilities, damages, demand, settlement, loss, expenses and costs (including solicitor fees and court costs) which may arise directly or indirectly out of or relate to (a) any breach of this agreement, or (b) the gross negligence or willful misconduct of a party’s employees or agents.
17. Acceptance of CoWork Crèche terms and conditions
17.1. Usage of CoWork Crèche services indicates that you have read and fully understood the above terms and conditions and accept them.
